Overview
A rent agreement records the terms on which a landlord lets a property to a tenant: the rent, deposit, duration, who pays for what, and how either side can end the arrangement. In many states, residential arrangements are written as a leave-and-licence agreement, which carries different legal consequences from a lease.
Stamp duty depends on the state and usually on the rent and period. A lease of more than one year must be registered under the Registration Act, which is why many residential agreements run for eleven months. Where registration applies, both parties and two witnesses appear before the sub-registrar.
Rent also carries tax points: the landlord reports rental income, the tenant may claim house rent allowance with rent receipts, and tax deduction on rent applies in some cases once the monthly rent is above a prescribed amount.
Is a written agreement needed?
Even for short arrangements, a signed and stamped agreement avoids most disputes.
Usually a good fit if
- You are letting out or renting a flat, house, room or shop.
- You need an agreement for address proof, a bank account, GST registration or a company's registered office.
- You want clear terms on deposit refund, repairs and notice.
- You are a tenant claiming house rent allowance and want proper records.
Think twice if
- The lease term is long or the rent is high; a registered lease deed prepared with more care is advisable.
- The property is under dispute or has unclear ownership; resolve that first.

Frequently asked questions
Is registration compulsory for a rent agreement?
A lease of more than one year must be registered. For eleven-month agreements, registration is not compulsory in most states, though local practice varies.
What is the difference between rent agreement and leave and licence?
A leave and licence gives permission to use the property without creating an interest in it, while a lease creates a limited interest. The legal protection for tenants differs, and many residential arrangements are written as leave and licence.
How is stamp duty decided?
It depends on the state, the rent, deposit and duration. We calculate it for you and arrange the e-stamp.
Can the agreement be used as address proof?
Yes, a properly stamped and signed agreement is widely accepted, along with utility bills.
Does the tenant need to deduct tax on rent?
Individual tenants paying above a prescribed monthly rent have to deduct tax at a set rate and deposit it. Businesses have their own rules.
Can a rent agreement be changed later?
Yes, by a written addendum or a new agreement signed by both parties.
